Status Report

The Academic Senate is working with the Chancellor's Office, Board of Governors and the Consultation Council to free system policy determinations from the threat of veto by the Department of Finance.

Whereas, Educational policy recommendations for the California Community College System are the result of considered Academic Senate deliberations, Consultation Council review and Board of Governors action;

Whereas, The Board of Governors is empowered by the California Education Code to set educational policy for the California Community College System;

Whereas, The California Department of Finance increasingly uses its finding of unfunded mandates to establish, to block or to make fundamental changes to educational policy actions; and

Whereas, Recent examples of Department of Finance intervention have included policy decisions in the areas of distance education regulations and the California Articulation Numbering System;

Resolved, That the Academic Senate affirm the principle that educational policy be established by Academic Senate deliberations, Consultation Council review and Board of Governors action;

Resolved, That the Academic Senate publicly affirm that it is completely inappropriate for the California Department of Finance to establish, block or change educational policy based solely on fiscal considerations;

Resolved, That the Academic Senate seek legal clarification and a legislative solution to this problem; and

Resolved, That the Academic Senate prepare a short analysis and critique to publicize this concern.
