Whereas Proposition 187 violates the equal protection clause of both the State of California and the United States Constitutions, and

Whereas Proposition 187 appears to be in conflict with several federal laws that could result in the loss of federal revenue for California, and

Whereas the implementation of Proposition 187 would require community college districts to deny access to education and report any student or applicant reasonably suspected of being an illegal immigrant leading to judgments made on the basis of accent, appearance, and foreign sounding surnames, and

Whereas Proposition 187 would require community college districts to expend resources better spent on education rather than investigation of the immigrant status of its students and litigation resulting from possible civil rights violations, creating a climate of fear and uncertainty which is not conducive to teaching or learning,

Resolved that the Academic Senate for California Community Colleges urge a no vote on Proposition 187, and

Resolved that the Academic Senate for California Community Colleges encourage students to continue their educational endeavors without fear.
